What are the key terms for using Off Market Properties services?

Answer: Our transparent fee structure is $4,000 retainer + 2% total for buyers. For sellers, listing is free — an optional $299 AUD video walkthrough is available (properties between Broadbeach and Cabarita), fully refundable when the property sells or automatically after six months. All users must provide accurate information, respect confidentiality of off-market listings, and comply with applicable property laws.

Acceptance of Terms

By using Off Market Properties, you agree to these Terms of Service. If you disagree with any part of these terms, you may not use our service.

Service Description

Off Market Properties is a platform that connects property sellers with qualified buyers through private, off market listings. We facilitate introductions but do not guarantee sales or purchases.

User Responsibilities

When using our platform, you agree to:

  • Provide accurate and truthful information
  • Comply with all applicable laws and regulations
  • Respect the privacy and confidentiality of other users
  • Not use the service for illegal or fraudulent purposes
  • Maintain the confidentiality of off market listings

Property Listings

Property sellers warrant that:

  • They have legal authority to sell the property
  • All property information provided is accurate
  • The property is free from legal disputes
  • They will honor the agreed terms of any paid walkthrough service, including its refund conditions

Fees and Payment

Listing a property with us is free. Sellers may optionally pay $299 AUD for a video walkthrough (available for properties between Broadbeach and Cabarita), which is refunded when the property sells, or automatically after six months if it hasn't. Additional terms regarding payment and refunds are provided at the time of purchase.

Privacy and Confidentiality

Off market properties are confidential. Users must not disclose property details, pricing, or seller information to unauthorized parties.

Limitation of Liability

Off Market Properties acts as a facilitator only. We are not responsible for:

  • The accuracy of property information
  • Completion of property transactions
  • Disputes between buyers and sellers
  • Property valuations or investment advice

Termination

We reserve the right to terminate access to our service for users who violate these terms or engage in inappropriate conduct.

Australian Law

These terms are governed by Australian law. Any disputes will be resolved in Australian courts.
